Judge refuses to re-sentence South Carolina Lawmaker in corruption case

A circuit court judge says she will not re-sentence former House majority leader Rick Quinn because of an earlier move by a prosecutor.

Judge Carmen Mullen's ruling came Tuesday.

Quinn has plead guilty to misconduct while in office and was sentenced to two years of probation.

Prosecutor David Pascoe asked the judge to consider a stiffer sentence in the statehouse corruption case.

But Judge Mullen wrote that the prosecutor should not have accepted Quinn's plea to a single charge if he wanted a harsher sentence.

Pascoe says he disagrees with Mullen but did not say whether he would appeal.
